1. About these terms

These terms are between [Company Name] Ltd, a company registered in England and Wales with company number [Company number], whose registered office is [Registered office address] (“Amble”, “we”), and the business that signs up to use Amble (“you”, “your studio”).

You accept them by ticking the box when you create your studio, or by using Amble. If you accept them for a business, you confirm you have the authority to do so.

They include our Data Processing Agreement and our Acceptable Use Policy. Our Privacy Policy explains how we handle personal data.

2. Who can use Amble

Amble is for businesses, including sole traders, using it for their trade. You must be 18 or over, and the details you give us must be accurate and kept up to date. These terms are not for consumers: members of a studio use Amble under our Member Terms.

3. The service

Amble is software for running a gym or studio: branches, class timetables, bookings and waiting lists, member records, credit packs and memberships, card payments through Stripe, registers and check in, reports, messages to members, and a booking app for your members in your studio’s name.

We improve Amble all the time and may add, change or remove features. If we remove something you rely on in a way that matters, we will tell you first.

4. Your account and your team

You are responsible for who you invite, the role you give each of them and keeping sign in details secure. An organisation admin can see and change everything in your studio, including member records, so give that role with care. Tell us straight away at hello@ambleclub.com if you think an account has been compromised.

5. Plans, free trial and the pilot

Amble has a free plan and paid plans. Plans differ in how many members and locations they allow, and the product enforces those limits: once you reach your plan’s member limit, adding another member is refused until you upgrade. Current plans and prices:

PlanMembersLocationsPrice a month
Free251Free
Starter1001£29
Studio2503£59
Pro600Unlimited£99
UnlimitedUnlimitedUnlimited£149

The free plan has no time limit. New paid subscriptions start with a 30 day free trial, once per studio: cancelling and subscribing again does not start another. You will not be charged if you cancel before the trial ends.

The founding studio pilot. If we invite you into our pilot, anything we agree for it that differs from these terms, such as a price or how long it lasts, will be confirmed to you in writing by email. It applies alongside these terms, and where the two differ the written pilot arrangement wins for as long as it lasts.

6. Fees, billing and renewal

Paid plans are billed monthly in advance through Stripe and renew automatically until you cancel. Fees exclude VAT, which is added where it applies.

We will give you at least 30 days’ notice by email before a price change takes effect, so you can cancel first if you want to.

If a payment fails, Stripe will try again and we will let you know. If it still cannot be collected, we may move your studio to the free plan or pause paid features until it is paid.

7. Cancelling

You can cancel a paid plan at any time from your billing settings. You keep everything your plan includes until the end of the period you have paid for, then your studio moves to the free plan. We do not refund part of a period unless the law requires it.

To stop using Amble altogether, cancel your plan and close your studio from its settings. Section 16 explains how to take your data with you.

8. Taking payments from your members (Stripe Connect)

To take card payments you connect your own Stripe account. By doing so you agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. That agreement is between you and Stripe.

Payments from your members go straight to your Stripe account. You are the merchant of record for them, not Amble. We are not a party to any sale between you and your members, we never hold your members’ money and we never see their card details.

Refunds, chargebacks and disputes with your members are yours to handle, through Stripe and under your own policies.

Platform fee: on the free plan we take 2% of each payment your members make through Amble, deducted by Stripe at the time of the payment. On a paid plan we take no fee. Stripe’s own processing fees apply either way.

If you charge members for a late cancellation or a missed class, you set the amounts, and Amble shows your policy to members before they book and before they save a card for it.

9. Your responsibilities

  • Your classes and your rules. You own your class content, timetable, prices, booking, cancellation and refund rules and everything you say to your members. You are responsible for them being accurate, fair and lawful, including under consumer law.
  • Your members’ data. You are the controller for it. Give your members the privacy information the law requires and have a lawful basis for what you record.
  • Consents. Get the right consents from members, including explicit consent for health information and separate consent for marketing, and a parent’s or guardian’s consent for younger members where it is needed. Amble records consent and refuses health notes without it, but whether the consent is genuine is your responsibility.
  • Messages. Only send marketing to members who agreed to it, and honour every opt out. Win-back does this for you, but messages you write yourself are your responsibility.
  • Health and safety. You are responsible for running classes safely: qualified instructors, suitable equipment and premises, risk assessments, insurance and acting on what members tell you about their health.
  • Staying open when software is not. Keep a way to run your day without Amble, such as a printed register, in case the service is interrupted.

10. Acceptable use

You and your team must follow our Acceptable Use Policy, and make sure your members can do the same.

11. Your licence and our intellectual property

While your subscription lasts, we give you a limited, non-exclusive, non-transferable licence to use Amble for your own business. You may not sublicense it, resell it or offer it as your own product.

We own all intellectual property in Amble: the software, its design, the Amble name and its content. You own your content and your data. You give us a licence to host, copy and process them only as needed to run Amble for you.

12. Feedback

If you send us ideas or suggestions, we may use them freely to improve Amble, without owing you anything for them.

13. Your data and data protection

Your member records are yours. For your members’ personal data you are the controller and we are your processor, under our Data Processing Agreement. We do not use your data for our own purposes, sell it or use it to train anything.

We apply default retention periods so records do not build up for ever, as the Privacy Policy describes. If you must keep something longer by law, tell us.

14. Availability

We work to keep Amble available and quick, but we do not guarantee any level of uptime. Maintenance, an outage at one of our providers or something we did not foresee may interrupt it. We will try to give notice of planned maintenance that affects you.

15. Suspension and ending the agreement

You can end this agreement at any time by cancelling your plan and closing your studio.

We can end it by giving you 30 days notice by email. We can suspend or end your access straight away if you seriously break these terms or the Acceptable Use Policy, do not pay what you owe, use Amble unlawfully, or put the security of Amble or other studios at risk. Where it is reasonable, we will warn you first and give you the chance to put it right.

16. Taking your data with you

You can download your reports and each member’s full record from Amble at any time. When your agreement ends you have 90 days to export your data, and if you ask within that time we will send you your member list and history as CSV files. After 90 days we delete it.

We keep only what the law requires us to, such as invoices, and anonymised records that no longer identify anyone.

17. Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow to be limited.

Subject to that, we are not liable for loss of profit, revenue, business, goodwill or anticipated savings, for loss or corruption of data beyond restoring it from our backups, or for any indirect or consequential loss.

Subject to that, our total liability to you for everything arising out of or in connection with these terms, in any twelve months, is limited to the fees you paid us in the twelve months before the event that gave rise to the claim.

18. Indemnity

You will indemnify us against claims by third parties, and the reasonable costs of dealing with them, that arise from your classes and premises, your content, your messages to members, or your breach of these terms, the Acceptable Use Policy or data protection law.

19. Changes to these terms

We may update these terms. For a change that matters, we will email your organisation admins at least 30 days before it takes effect. If you do not agree, you can cancel before then. Continuing to use Amble after a change takes effect means you accept it.

20. General

These terms, with the documents they include, are the whole agreement between us about Amble. If a court finds part of them unenforceable, the rest still applies. You may not transfer this agreement without our written consent; we may transfer it to a company that takes over Amble, and will tell you. Nobody else has rights under it. Neither of us is liable for delays caused by events outside our reasonable control.

21. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
